Anouk was born in Holland but raised in Malawi and Kenya. She left Africa to complete her BA and MSc in the UK before marrying and moving to the US. Africa is where her heart has always remained, and with over 25 years of experience in the Africa travel industry, she has managed to return to the continent on a regular basis. She’s extended her experience way beyond “home” to include North, Central and West Africa on her many adventures. Highlights include gorilla tracking in Rwanda, canoeing down the Zambezi, sand-boarding down the Skeleton Coast dunes, and hot-air ballooning over the great migration in the Serengeti.

“When I was young my parents would take us on safari every few months in our old Fiat. I would oscillate between boredom and terror when we encountered anything larger than an impala. It wasn’t until I traveled as an adult, and encountered excellent guides and great camps that I understood the difference between just driving around a wildlife reserve, and being guided on a quality safari. It’s now become a passion to share my love for Africa’s wildlife and its cultures with clients. I guarantee the experience will never be boring, and always authentic, exciting, and hopefully life-changing.”

About your itinerary

Your journey begins with a night at The Residence in Johannesburg, a serene and elegant retreat to unwind after your flight. The next morning, fly to Durban and transfer to Rhino Sands Safari Camp, an intimate luxury tented camp set within the pristine Manyoni Private Game Reserve. AFRICAN PORTFOLIO, INC. - TERMS and CONDITIONS, RELEASE, ASSUMPTION OF RISK, and BINDING ARBITRATION AGREEMENT


Responsibility


African Portfolio Inc. (African Portfolio) books transportation, accommodation, adventure activities and other services from various foreign, independent ground operators/suppliers, who are not owned or supervised by, or subject to the control of African Portfolio. Services provided by these operators/suppliers are offered subject to the terms and conditions contained in the tickets, itineraries, websites or booking confirmations issued by them as well as to these Terms and Conditions. African Portfolio is not liable for any personal injury, financial default or property damage that may occur due to: 1) wrongful, negligent or any other act or omission on the part of a supplier, its employees or others not under the direct control of African Portfolio; 2) defects or failure of any aircraft, vessel, vehicle or other equipment, closure of property, inability to provide services or ensure the quality thereof, which services are under the control of independent suppliers; and/or 3) acts of God, including but not limited to natural disasters, acts of government or public health epidemics or pandemics.


African Portfolio is not responsible if the internal infrastructure of a country causes adverse effects that prevent the ground operator from delivering the usual standard of service. Nor is African Portfolio responsible for problems resulting from the hazards of traveling in politically unstable areas or arbitrary changes or other restrictions mandated by government or private authorities. Safaris by their nature, are adventure holidays and as such, changes in the details and timing of an itinerary can vary from time to time, depending on conditions prevailing and facilities available.


Land, Sea and Air Transportation

 

Carriage by land, sea and air is subject to the terms and conditions of the carrier and to international conventions, which may limit liability. Land, sea and air travel are also subject to financial and operational decisions of carriers and air/seaports which may result in cancellations, delays or diversions over which African Portfolio has no control and for which African Portfolio is not liable.

 

Binding Arbitration

 

I agree that any dispute concerning, relating or referring to this Agreement, the brochure or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§1-16, according to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) Connecticut law and will take place in Hartford, Connecticut. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable. Please understand that by agreeing to these terms and conditions, you (and we) are waiving our right to a trial by jury. Any arbitration commenced against African Portfolio must be on behalf of only the signatory to this Agreement and his or her immediate family members who traveled with signatory, such as a spouse or child. Under no circumstances can a participant be part of a class or other joint action.


Assumption of Risk

 

I acknowledge that I have voluntarily applied to participate in the trip designated on this application (or a trip to which I may subsequently transfer). I am voluntarily participating in this trip with the knowledge of the numerous risks and dangers involved including but not limited to: negligence in any manner on the part of African Portfolio including, without limitation, negligence in the conduct or arrangement of the trip in any respect from inception to completion, in the maintenance or operation of any van or other motor vehicle utilized to transport passengers, etc.; acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, acts of government, strikes or other labor activities; physical exertion for which I am not prepared; forces of nature; weather conditions; transportation failures or the failure of any transportation mechanism to arrive or depart timely or safely, whether by plane, train, auto, boat, canoe, kayak, bicycle, ski, horseback or other animal, by foot, or by any other conveyance; consumption of alcoholic beverages; risks associated with food or impure water; terrorism or the threat thereof; criminal activity or the threat thereof; bites from or dangers associated with wild or other animals, pests, insects, flora or fauna; negligence or willful misconduct by third parties; breakdown or failure of equipment; financial default of any supplier; high altitude; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; the adequacy of medical attention once provided; epidemics or the threat thereof; stolen, lost, or misplaced luggage or property; and theft or break-ins into vans, lodging rooms or elsewhere. I accept all such risks and hold African Portfolio harmless therefrom. I also release African Portfolio from its own negligence.

 

I acknowledge that the enjoyment and excitement of adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I hereby agree to be responsible for my own welfare and accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death.

 

Booking Procedures and Payment Terms

 

African Portfolio requires completion of our online reservation process, acceptance of these Terms and Conditions and a $500 per person non-refundable reservation fee to make a provisional reservation. African Portfolio will confirm a provisional reservation upon receipt of a further non-refundable deposit of 30% of the tour price. (Note: Travel during peak holiday periods, with certain safari operators or for groups of 10 or more travelers may be subject to an additional deposit or early payment requirements). The reservation fee and deposit are fully non-refundable but are applied to the tour price. Any airfare quotes are estimates only and are subject to change until tickets are issued. Unless otherwise specified, ticketed flights are non-refundable. Amendments to flights are subject to applicable change fees and any increase in fare. The balance of payment is due ninety (90) days prior to departure date. Failure to remit payment by the stated due date will be deemed a cancellation by the client. Reservations made within ninety (90) days of departure are subject to full payment upon confirmation. The client is fully liable to African Portfolio for any deposit requirements, cancellation fees and contractual obligations the company has undertaken on behalf of the client with all service providers including ground operators, suppliers or airlines.

 

Insurance & Travel Protection

 

Adequate insurance coverage is essential. It is your responsibility as a condition of both booking and travel with African Portfolio, to ensure that you carry the correct comprehensive travel and medical insurance to cover yourself, as well as any dependents and traveling companions for all elements and the full duration of your trip. This insurance policy should include cover for, but not limited to, the following eventualities: cancellation or curtailment of the trip, emergency evacuation expenses (minimum value of $500,000), medical expenses, repatriation expenses, damage or loss of personal baggage, money and goods. We will take no responsibility for any costs for losses incurred or suffered by you or your dependents or traveling companions, with regards to, but not limited to, any of the above-mentioned event qualities. You will be charged directly by the relevant service providers for any emergency services you may require and may find yourself in a position unable to access such services should you not be carrying the relevant insurance coverage. If you make any changes to your itinerary after purchasing your travel protection, it is your responsibility to notify your travel protection provider to ensure your coverage is still valid for the updated itinerary.

 

Refunds and Change Fees

 

No refunds will be issued for any unused accommodation, tours, activities, meals or services, including the cancellation of domestic and regional air tickets. A $250 per person service fee will be charged for any requested changes to air or land arrangements within 90 days of departure or once a final invoice is issued.

 

Cancellations

 

a)         African Portfolio will not cancel the travel arrangements once full payment is received unless it becomes necessary due to hostilities, war or threat of war, civil strife, industrial dispute, terrorist unrest, active or threatened, natural or nuclear disaster, public health threats, epidemics, pandemics, fire or adverse weather conditions, or if a group tour does not have the minimum required participants, or for any other adverse event beyond the control of African Portfolio. In the event of such a cancellation, African Portfolio will inform the client and will attempt to offer a suitable and comparable alternative.

b)         If a client chooses to cancel the trip, applicable cancellation fees are:

At time of Reservation Fee payment to 90 days prior to travel: Fees are 100% of the reservation fee, deposit and any other charges paid prior to 90 days (flights, trekking permits).

From 90 days – 0 days prior to departure: Fees are 100% of the tour cost

c)         In addition, clients are subject to all cancellation fees imposed on African Portfolio by suppliers and airlines.

d)         All cancellations must be in writing, signed by the client and effective upon receipt and acknowledgement by African Portfolio.

 

Your Personal Information

 

African Portfolio collects personal information about our clients including but not limited to: full name, email, address, passport details, nationality, dietary restrictions, physical limitations, wedding anniversary, birthdate, and other personal information. This information is necessary to provide you with a customized travel service. This information is securely stored and will never be sold to third parties but will be disseminated to suppliers for use on the trip.

 

Removal of Personal Information

 

After you return from your trip, if you would like African Portfolio to delete your personal data, you can send a request in writing to onsafari@africanportfolio.com with the subject line “Delete My Data” and African Portfolio will delete all personal data collected about you. If you do not request the removal of your personal information, African Portfolio will continue to store your personal information for your next trip with us.

 

Requesting A Copy of Your Personal Information

 

If you would like to receive a copy of your personal information stored by African Portfolio, please send a request in writing to onsafari@africanportfolio.com with the subject line “Request A Copy Of My Data” and African Portfolio will provide you with a copy of your personal data.
